By booking our services you are entering an agreement with us; please read the booking terms and conditions below.

01. | HIRER

1.1. The Hirer must be over 18 years of age.

02. | BOOKING TERMS

2.1. Once you have approved and signed the proposal and quotation, a non-refundable booking fee of 50% of the total package value is required within 7-days to secure/book your wedding/event date. This fee will be deducted from the total cost of your package. Bookings are considered tentative, and not confirmed, until the required 50% deposit is paid and the booking Terms and Conditions are signed.

2.2. Bookings are considered tentative until the 50% deposit has been received and the Hire Contract has been filled out and signed.

2.3. Failure to complete the payment and return the Hire Contract form within 7 days will result in your reservation date being released

2.4 The remaining balance, along with any adjustments, is due 30 days prior to your event. Failure to make payment by the specified deadline will result in an additional 10% fee for each 7-day period that the balance remains unpaid. Should the balance not be settled within 30 days of the event, flowers and décor will not be ordered, and this contract will be considered closed, with no refunds issued.

03. | BALANCE OF INVOICE

3.1. Payment in full is required 30 days prior to your event date. If full payment has not been received 30 days prior to the date of the event, Territory Nights reserves the right to cancel their obligations under the contract and you agree to indemnify Territory Nights against all losses that may be incurred by you due to non-fulfilment of the contract.

 

04. | LABOUR, DELIVERY AND PICK UP FEES

4.1. A delivery and pick up fee will be calculated based on the location of your event and added to your total event package price. If the location of your event changes prior to your event date, an additional delivery and pack down fee may be charged.

4.2. Labour late night, Sunday and Public Holiday surcharges apply to all delivery and collections outside of business hours. Please note that the minimum pack down time is 45 minutes from commencement of pack down.

 

05. | LOST OR DAMAGED ITEMS

5.1. The Client is responsible for loss, damage or breakage of all items hired on collected items until returned, or on delivered items until collected. Replacement costs are as of current days pricing and are payable as cash settlement.

5.2. The Client will be required to pay for lost or damaged items, at a replacement cost price, within 7-days of Territory Nights issuing an invoice.

 

06. | CANCELLATIONS

6.1. Should the Client cancel their booking; the deposit will not be refunded.

6.2. Territory Nights is happy to permit ONE new date transfer for the original booking subject to availability, as we understand that sometimes things do happen. This change must be made 30 days prior to your confirmed booking date. Should it be less than 30 days, your deposit is forfeited.

 

07. | LINEN CARE

7.1 The Client is responsible for the care of all linen and fabric materials hired. All linens must be returned free of food, stains, or damage. Any stained or heavily soiled linens upon return will incur an additional cleaning fee of minimum $10.00 per item. Damaged linens will be charged at full replacement cost.

 

08. | BREAKAGES

8.1. The Client agrees to take care of all hired items. Any items that are broken, lost, or damaged beyond repair will be charged at the replacement value as determined by Territory Nights. The Client will be billed for any damages within seven (7) days of the event.

 

09. | TRAVEL

9.1. Territory Nights services Darwin, Palmerston, and parts of the Rural Area. We are keen to service a wider area however a travel surcharge will apply [please discuss for details].

 

10. | SITE ACCESS

10.1. Long distances or difficult access (e.g. stairs/lifts/beach etc.) must be discussed prior to your event so plans can be put in place. Failure to bring such issues to our attention may incur additional fees. Please note there should be ample parking for our vehicle/s and trailer within the required proximity.

10.2. A distance of no more than 25 - 30 metres from the designated carpark or access site to the setup location must be allocated.

10.3. The Client must arrange for appropriate access and approvals to the site for delivery and pick-up. If we are unable to access the site for pick-up after the event – an additional fee may apply.

10.4. If there is a requirement to move furniture or items at your event location to enable Territory Nights to setup and style your event, please be sure to make arrangements with the venue for this to occur prior to our arrival at the event location and after our pack up. If Territory Nights is required to move furniture or items at the venue location to setup and style your event on the day – we must be advised prior to the event date and an additional fee will apply

 

11. | HIRE PERIOD AND INSTALLATION

11.1. The hire period is stipulated in your contract. We endeavour to have your setup completed as follows:

○ Picnic/Baby Shower - 15 minutes prior to your agreed booking time.

○ DIY Hire – as per agreed drop off and pick up time with you.

○ Ceremony - 45 minutes prior to your agreed booking time.

○ Reception - 45 minutes prior to your agreed booking time [venue dependant].

○ Special Event - 45 minutes prior to your agreed booking time [venue dependant].

11.2. The Hirer must not remove the hired items from the site or their position of installation; alter the hired items, repair or attempt to repair the hired items; or use the hired items for a purpose which is different from that for which it is designed, without the authority and approval of Territory Nights.

 

12. | STYLING SETUP AND PLACEMENT

12.1. Final styling setup of hire items on the day will be placed according to final agreed venue site layout plan with the hirer prior to event date. Territory Nights cannot change final placement of hire items on the day of event due to an unplanned weather event or other circumstances unless Territory Nights has additional time available on the day to action the layout change. The hirer must have a wet/wind weather plan already organised and agreed when there is the potential for wet or windy weather on the event date.

12.2. Please note that festoon and/or fairy lighting set-ups cannot be moved at the venue or property once they have been installed for the event.

 

13. | RUBBISH REMOVAL AND SITE CLEAN UP

13.1. Our role at Territory Nights is to setup and style your event as per our agreed styling scope. This does not include the removal of rubbish [food, cans, bottles, cutlery, etc.] left behind by other vendors or your guests. We expect that all of our items are left clean for us to collect and if not, an excess cleaning charge of $150.00 per hour will apply.

 

14. | WEATHER CONTINGENCY

14.1. In the event of inclement weather, the Client will be responsible for ensuring that all hired items are adequately protected. Territory Nights will not be liable for damage to hired items due to weather conditions; however, if severe weather conditions make it unsafe to proceed with the event, a rescheduling option may be provided, subject to availability.

15. | WILDLIFE

15.1. It is our duty of care to ask that you do not pour alcoholic beverages out onto the grass; including fruit laced with alcoholic punch. Most of our setups are done where there is a lot of wildlife and this can be harmful to them should it be ingested. Please ensure you remove it from the premises completely or pour down an appropriate drain.  

16. | PERMISSIONS

16.1. No smoking is permitted near soft furnishings [e.g. couches, rugs, cushions etc.]

16.2. No candles, no fire pits, no open flames or gas lights are to be used on or near any equipment supplied by Territory Nights unless provided by Territory Nights themselves.

16.3 No pets are permitted on any equipment supplied by Territory Nights.

17. | FORCE MAJEAURE

17.1. Territory Nights reserves the right to reschedule bookings due to bad weather conditions. No refunds will be made if weather conditions result in the Client cancelling the event on the day or within 24 hours of the booking.

17.2. Territory Nights does not take any responsibility for any other cause that is beyond the control of Territory Nights which they could not foresee or have foreseen which may affect your event occurring as planned. We will do everything we can on the day to ensure we deliver your event specifications if possible; however, we cannot guarantee this if conditions prevent Territory Nights delivering your event.

17.3. Should your event location be placed under any restrictions, including COVID-19 restrictions, on your event date and Territory Nights is unable to operate as normal, the following conditions will apply:

○ Postponements must be in writing and for the original booking only.

○ A new date will be subject to our availability.

○ No cash refunds.

○ Postponements must be used within 12 months of the original date, or all payments and the event will be forfeited.

 

INDEMNITY: The Hirer must at all times indemnify Supplier against all damages, costs, charges, expenses, actions, claims and demands which may be sustained, suffered, recovered or made against Supplier by any person for any damage to property, animal or thing, death or any injury that a person may sustain when using, entering or being near any part of the services supplied by Supplier which arises as a result of any cause or reason whatsoever, whether it arises naturally, negligently or otherwise except to the extent caused by a wilful act of Supplier of its employees. In respect of use of the Goods, to the extent that our loss is caused by our negligence, your liability is diminished. All items are not insured and it is the responsibility of the Hirer to insure if necessary

ACKNOWLEDGMENT AND AGREEMENT TO THE TERMS AND CONDITIONS 

Agreeing to the booking by paying the initial deposit and signing your proposal confirms the event booker acknowledges that they have read, understood and accepted these terms and conditions.
